MJ Insurance, Inc. dba The MJ Companies and our affiliates (hereinafter collectively referred to as “MJ” “us,” “we,” “our,” or “Company”) has created this Privacy Policy to disclose how we collect, use, share, and protect information about you, as well as to inform you of privacy rights you may have and how to exercise them. MJ is committed to protecting the privacy and security of your information. This Privacy Policy applies to anyone who interacts with MJ through our offices, websites, products, and services (collectively, our “Services”).

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we may use or disclose your information. By accessing or using our Services, you consent to the use of information that is collected, submitted, used or shared as described in this Privacy Policy. If you do not agree with our policies and practices, your choice is not to use our Services. This Privacy Policy may change from time to time. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.

I. Privacy Policy Scope

This Privacy Policy applies to the personal information of users of our Services except as described below.

This Privacy Policy does not apply to information collected by or provided in connection with an individual’s current or former employment or independent contractor arrangement with MJ. If you are an MJ employee, independent contractor, or applicant for employment, please see the MJ Notice at Collection for California Employees and Applicants for information about how MJ collects, uses, processes, discloses, shares, and retains employment information not covered by this policy. 

This Privacy Policy applies to information collected from consumers or processed in MJ’s capacity as a data controller under applicable data protection laws. Data collected, used, or shared in MJ’s capacity as a data processor is governed by relevant contracts or service agreements and the data controller’s privacy policy and is outside of the scope of this Privacy Policy.

This Privacy Policy does not apply to the practices of third parties that we do not own or control even if you access the third-party site from our website(s) and/or application(s) (collectively, our “Website”).  We have no control over or responsibility regarding the information collected from you by others, such as third-party websites that you access through links on our Website. Instead, such information practices are governed by those entities’ privacy policies. Please review the privacy policies of any third-party websites for information on how those entities collect and use your information.

This Privacy Policy does not apply to Protected Health Information (“PHI”) as defined by HIPAA or other applicable laws. 

A.    Types of Personal Information We Collect

Personal information means any information that identifies, relates to, describes, or could be reasonably associated or linked with a particular person or household. It also includes other information that may be associated with you, such as your usage data, location, preferences, or interests, if that information can be used to identify you, your household, or your device, or any other information as otherwise defined under applicable law. Personal information does not include publicly available information from government records or deidentified or aggregated consumer information.

The types of personal information we collect about you depend on your interactions with us and are described in more detail below.

MJ collects the following types of information from you and other users who use our Website or Services:

We also collect your communications with us, preferences, and other information you provide to us, including any messages (including via online chat feature), opinions, and feedback that you provide to us, your user preferences (such as in receiving updates or marketing information), and other information that you share with us when you contact us directly (such as for customer support services).

Sensitive Information. We may process the following categories of sensitive personal Information when you use our Services:

  • Driver’s license, state identification card, passport number;
  • Debit card, or credit card number in combination with any required security or access code;
  • Union membership;
  • Information concerning health; and/or
  • Citizenship or immigration information.

In some instances, MJ collects or processes Sensitive Information to infer characteristics about you, among other purposes.  Depending on your place of residence, you may have the right to request that MJ limit the use and disclosure of your Sensitive Information by contacting us via the information in the CONTACT US section below.    

B.    How We Collect Information

We generally collect personal information and create and maintain records about individuals for our legitimate business purposes and in relation to the Services we provide to you. We collect (1) information you provide to us; (2) information we may automatically collect; and (3) information we may receive from third parties. 

  1. Personal Information You Provide to Us:  We collect information that you decide to share with us. For example, we collect personal information directly from you when you engage with our Services through our Website or our mobile application, sign up for our mailing list, register for an MJ membership account, contact us via email or a form on our Website, engage with us on social media, or otherwise interact with us or use our Services. At times, we may require you to provide certain information, including personal information, in order to provide you with Services you request. For instance, we may require you to provide your name, email address, and payment card information when you use our Services. We may also require you to provide your name, email address, or other contact information when you contact us with a question or comment. In some circumstances, we will not be able to further our relationship with you (for example, to fulfill an order you place) without certain personal information. We will inform you at the relevant time if this is the case.

We collect any other information or content you provide to us, such as when you provide feedback about our products or services or make other submissions to us or use other features of our Services that may be offered from time to time, which may require the collection of certain personal information in order to utilize the features. Examples of user content data may include information about your opinions, feedback, preferences, and any other personal information you choose to provide in your interactions with us.

  • Personal Information We Collect Automatically:  We automatically collect certain personal information when you access and use our Services. The types of information we collect may include:
    • Internet Activity. We collect certain information about your internet activity when you use our Website and Services. Such information may include your IP address, operating system, and browser type.
    • Usage Data. MJ collects information about your activity on our Services, including details of your visits to our Website and other communication data and the resources that you access and use on the Website.  MJ collects information via cookies and similar technologies. Please see the “Cookies” section below for more information on cookies and your cookie choices.
  • Personal Information We Collect from Other Sources: We may collect personal information about you from other sources such as publicly available sources, and/or other external agencies, but always in accordance with the authorization procedures and privacy settings you establish with the other sources. We may also collect personal information stored by third parties such as social media sites (e.g., Facebook and Twitter) if you choose to provide us access to that information. The information we may receive varies by site and is controlled by that site. By associating an account managed by a third party with your MJ account and authorizing MJ to have access to this information, you agree that MJ may collect, store and use this information in accordance with this Privacy Policy.
C.    How We Use Your Information

MJ may use the information it collects in a variety of ways for its business or commercial purposes, such as to:

  • Facilitate your use of the Services;
  • Confirm your eligibility to use the Services;
  • Fulfill your requests and provide support;
  • Facilitate your movement through the Services;
  • Send you communications such as administrative e-mails, promotional e-mails, answers to your questions, and updates about the Service, by letter, e-mail, or other forms of communication;
  • Improve the Website’s content, features, and/or Services;
  • Improve or develop new MJ Services, and/or marketing efforts;
  • Analyze traffic to and through the Website;
  • Monitor and analyze user behavior and activity on or through the Website in order to keep the Website secure and personalize your user experience;
  • Protect or enforce MJ’s rights and properties;
  • Protect or enforce the rights and properties of others;
  • In any way we may describe when you provide the information;
  • Comply with applicable laws, in response to a lawful and enforceable request by a law enforcement, judicial, or other public authority, or in connection with an applicable legal obligation; and
  • Where you otherwise have given MJ your consent and permission to do so.
D.    How We Disclose Your Information

We may disclose your personal information to third parties to help provide our Services to you. For instance, we may disclose your information with our service providers to respond to your requests or to provide customer service. We may also provide your personal information to third parties who assist us in providing certain services. For example, we may provide the information we collect from you to our cloud hosting service providers, or our payment card processing providers. We may also disclose your information to our affiliates. We may disclose aggregated information about our user and information that does not identify any individual without restriction.

We may also disclose your information for the following purposes:

  • To facilitate and improve the quality and marketing of our Services;
  • To protect our users and network against fraud and security threats;
  • To comply with a legal obligation;
  • To protect and defend our rights or property;
  • To prevent or investigate possible wrongdoing in connection with the Services;
  • To protect the personal safety of individuals or the public;
  • To protect against legal liability;
  • When there is a good faith belief that such action is necessary to investigate or protect against harmful activities to our guests, visitors, associates, or property (including the Websites), or to others.  This may include disclosures to law enforcement to investigate potential criminal activity or other civil violations;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of MJ Insurance’s assets; or
  • With your consent.

We may disclose your information to the following types of entities and third parties:

  • Law Enforcement or Other Lawful Authority:  We may disclose your Information without notice: (i) when required by law or to comply with a court order, subpoena, search warrant, or other legal process; (ii) to cooperate or undertake an internal or external investigation or audit; (iii) to comply with legal, regulatory, or administrative requirements of governmental authorities (including, without limitation, requests from the governmental agency authorities to view your Information); (iv) to protect and defend the rights, property, or safety of us, our subsidiaries and affiliates, and any of their officers, directors, employees, attorneys, agents, contractors, and partners, and the Website Service users; (v) to enforce or apply our Terms & Conditions; and (vi) to verify the identity of the user of our Services.
  • Business Transfers.  Your Information may be transferred, sold, or otherwise conveyed (“Conveyed”) to a third party where we: (i) merge with or are acquired by another business entity; (ii) sell all or substantially all of our assets; (iii) are adjudicated bankrupt; or (iv) are liquidated or otherwise reorganize. 
  • Information Shared with our Subsidiaries and Affiliates.  We may share your Information with our subsidiaries and affiliates.
  • De-Identified or Aggregated Data.  We may share your Information on an aggregated basis for any purpose, in which your specific personal Information is blinded, masked, or otherwise not identifiable. 
  • With Your Consent.  We may share Information consistent with this Privacy Policy with your consent.
E.    Categories of Personal Information Sold

We have “sold” or “shared” the following categories of Personal Information. For purposes of this Privacy Policy, “sold” or “sale” means the disclosure of Personal Information for monetary or other valuable consideration. “Shared” means disclosing Personal Information for cross context behavioral advertising.

II.           How Your Information is Stored, Transferred, and Secured

A.    Data Transfers

MJ’s offices are located in the United States and our Services are not directed to clients in other jurisdictions.  If you are located in the European Economic Area (“EEA”) and you use our Services, this will involve transferring your personal information outside of the EEA. Many of our external third parties are based outside of the EEA, so their processing of your personal information will involve a transfer of information outside of the EEA. For example, MJ hosts the information it collects at its data center in the United States. As a result, your information may be subject to access requests from governments, courts, law enforcement officials and other lawful authorities in another jurisdiction according to its laws. Subject to the applicable laws, we will use reasonable efforts to ensure that appropriate protections are in place to maintain protections on the personal information.

B.    Retention and Deletion of Personal Information

We will retain your personal information for as long as necessary to provide our Services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected. Under applicable regulations, we will keep records containing client personal information, account opening documents, communications, and anything else as required by applicable laws and regulations. We will not retain your personal information or Sensitive  Information longer than reasonably necessary for the purposes for which the information was collected.

We may rectify or remove incomplete or inaccurate information, at any time and at our own discretion.

C.    Securing Your Information

MJ uses reasonable, appropriate, and customary procedures and technologies to help protect the confidentiality of any personal information we collect.  MJ employs reasonable administrative, physical, and technical safeguards to protect the information we collect, process, and store.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

However, no website, network, or system can be absolutely protected against intentional or malicious intrusion attempts despite taking appropriate and reasonable precautions. Furthermore, MJ does not control the devices, computer, or network through which you access the Website or over which you may choose to send personal information or other information to us, and therefore cannot prevent potential interceptions or compromises to your information while in transit. MJ makes no guarantee as to the security, integrity or confidentiality of any information transmitted to or from the Website. MJ is committed to safeguarding your information to the best of its ability but cannot guarantee the security of electronic communications or transmission made over the Internet.

D.    Cookies  & Technologies Used to Collect Information About You

We and/or certain service providers operating on our behalf may collect information about your activity, or activity on devices associated with you over time, on our sites and applications, and across non-affiliated websites or online applications.  We may collect this Information by using certain technologies, such as cookies, web beacons, pixels, software developer kits, third party libraries, and other similar technologies. Third-party service providers, advertisers, and/or partners may also view, edit, or set their own cookies or place web beacons.  

  • Cookies (or browser cookies).  A cookie is a small data file stored by your web browser on your computer’s hard drive – to track which areas of our Website are used the most and to help us make our Website more informative and user-friendly, and other purposes as described in this Policy. MJ may receive, store, and use the information you enter on our Website or which is collected during your visit to our Services. Such information will generally not personally identify you and may include the date and time of your visit, pages accessed, the web browser you use, the internet address of any website from which you linked directly to our Website and related information. Our Website uses the following types of cookies:
  • ‘Session cookies’ which are stored only temporarily during a browsing session in order to allow normal use of the system and are deleted from your device when the browser is closed.
  • ‘Persistent cookies ‘ which are read only by the Website, saved on your computer for a fixed period, and are not deleted when the browser is closed. Such cookies are used where we need to know who you are for repeat visits, for example to allow us to store your preferences for the next sign-in.
  • ‘Third party cookies’, which are set by other online services who run content on the page you are viewing, for example by third party analytics companies who monitor and analyze our web access.
  • Web Beacons.  Website pages may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).  We also use these technical methods to analyze the traffic patterns, such as the frequency with which our users visit various parts of the Services.  These technical methods may involve the transmission of Information either directly to us or to a third party authorized by us to collect Information on our behalf.  Our Services use retargeting pixels from Google, Facebook, and other ad networks.  We also use web beacons in HTML emails that we send to determine whether the recipients have opened those emails and/or clicked on links in those emails.
  • Analytics.  Analytics are tools we may use, such as Google Analytics, to help provide us with information about traffic to our Website and use of our Services, which Google may share with other services and websites who use the collected data to contextualize and personalize the ads of its own advertising network. E.    Your Cookie Choices

You are in control of how you want to allow cookies to be used on your devices. Most internet browsers are initially set to accept cookies. You may set your browser to block or otherwise control what cookies your browser or device accepts via your settings. Additionally, you can choose to modify your settings and delete cookies that are otherwise stored on your device. Please note that, if you choose not to accept cookies, some Website features and the personalization of our Services may no longer work for you. You will continue to receive advertising material, but it will not be tailored to your interests. Please consult the instructions provided by your browser or your mobile device manufacturer to determine how you can limit the placement of and/or remove cookies or other similarly used technologies.

F.    Our use of online tracking technologies may be considered a “sale” or “sharing” under certain laws.  To the extent that these online tracking technologies are deemed to be a “sale” or “sharing” under certain laws, you can opt out of these online tracking technologies by contacting via the information in the Contact Us section below..  “Do Not Track” Signals

Our Website is not currently designed to respond to “Do Not Track” signals. “Do Not Track” is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable “Do Not Track” by visiting the “Preferences” or “Settings” page of your web browser. Do Not Track is different from Global Privacy Controls (“GPC”), which may notify websites of consumers’ privacy preferences regarding the sale or sharing of Personal Information, or the use of Sensitive Information.     

Third parties may collect data that relates to you. We cannot control third parties’ responses to Do Not Track signals or other such mechanisms. Third parties’ use of data relating to you and responsiveness to Do Not Track signals is governed by their respective privacy policies.

G.   Children’s Privacy

All of our Services, including our Website, are intended for adult audiences, and are not directed to or meant for individuals under the age of sixteen (16) (“Children”). As such, we do not knowingly collect personal information from anyone under the age of sixteen (16), and Children under sixteen (16) may not use our Website or any of our Services.  If you are under sixteen (16), do not attempt to register for or use any of our Services, including our Website, and do not provide us any personal information about yourself. We may collect information pertaining to Children under sixteen (16) only if provided by a parent or guardian in the course of adding the Child as a dependent with regard to the Services.

If you are a parent or guardian and you are aware that your child has violated this Privacy Policy and provided us with personal information, please contact us. If we become aware that we have collected personal information from Children without verification of parental consent, we will take steps to delete that information.

MJ does not knowingly sell or share data of consumers under the age of sixteen (16).

III.        NOTICE TO CERTAIN RESIDENTS OF DATA SUBJECT RIGHTS

A.    Notice to California Residents

MJ has in place policies and procedures to facilitate the exercise of privacy rights available to California residents. To the extent any California data privacy law applies to the collection of your Information, this supplemental section of our Privacy Policy outlines the rights that California residents may have, and how they can exercise those rights.  This notice applies solely to California residents.  We provide the supplemental section below to comply with the California Consumer Privacy Act [as amended by the California Privacy Rights Act (referred to collectively hereinafter as CCPA)] and any terms defined in the CCPA have the same meaning when used below. 

  • Your Privacy Rights Subject to certain limitations, if you are a California resident, you have the following rights under California law:
    • Right to Access: You have the right to have access to your personal information upon verifiable request. You may receive a copy of such information upon receipt of a verifiable request, along with other information related to the collection or processing.
    • Right to Correct: You have the right to correct inaccuracies in the personal information that MJ holds about you upon receipt of a verifiable request.
    • Right to Disclosure of Direct Marketers: You have the right to have access upon simple request, and free of charge, the categories and names/addresses of third parties that have received personal information for their direct marketing purposes. 
    • Right to Information About Collecting, Selling, Sharing, or Disclosing Personal Information:  Upon receipt of a verifiable request, you may obtain a list of:
  • The specific pieces of your personal information MJ holds;
  • The categories of personal information collected about you, sold to or shared with third parties, or disclosed to third parties for business purposes;
  • The categories of personal information sold or shared within the last twelve (12) months;
  • The categories of sources from which personal information is collected;
  • The business or commercial purpose for collecting, selling, or sharing personal information; and
  • The categories of third parties with whom personal information is shared, sold, or disclosed for a business purpose.
  • Right to Opt-Out of the Sale or Sharing of Personal Information: You have the right to opt-out of the sale or sharing of their personal information under certain circumstances.   If you are age sixteen (16) or older, you have the right to direct us to not sell your personal information at any time. We do not sell the personal information of consumers we actually know are less than sixteen (16) years old. To exercise the right to opt-out, you (or your authorized representative) may submit a request via the information in the Contact Us section below. .
  • Right to Deletion:  You have the right to obtain the deletion of your personal information in the situations set forth by applicable data protection law and upon receipt of a verifiable request.
  • Right to Limit: You have the right to limit certain uses or disclosures of Sensitive  Information. Our uses of Sensitive Information are described in the Sensitive Information section above. You may limit the use of their Sensitive Information by contacting us via the information in the Contact Us section below.
  • Right to Non-Discrimination.  As defined under relevant law, you have a right to non-discrimination in the Services or quality of Services you receive from us for exercising your rights.
  • Right to Disclosure of Direct Marketers.  You have a right to the categories and names/addresses of third parties that have received personal Information for their direct marketing purposes upon simple request, and free of charge. 

Please contact us utilizing the methods listed in the “Contact Us” Section below in relation to exercising these rights. We may ask you to provide information about yourself so that we can verify your identity as part of this process. This information may include your name, email address, and any other information necessary to reasonably verify your identity, to ensure that your information is not shared with anyone impersonating you. We may ask for additional information if we have difficulty confirming your identity. Once we have verified your identity, we will work to fulfill your request in a timely manner. Please note there may be some situations in which we are unable to fulfill your request, such as if we cannot find any information about you within our systems. Additionally, we may not be able to honor a deletion request in some situations, such as if your information is necessary to fulfill the Services you requested or meet a legal obligation. We will inform you whether we can fulfill your rights request.

Authorized Agent

Under California law a consumer can appoint an “authorized agent” to make certain verifiable requests upon their behalf, such as the right to know what information we collect about the consumer or to request deletion of the consumer’s information. An “authorized agent” may submit a request on behalf of a California resident who has authorized the agent to act on their behalf. Because the security and privacy of your information is paramount, we will ask that you identify such persons and directly confirm that such persons are authorized to act as your agent and exercise your applicable rights under California law in such situations. This may require us to contact you directly and alert you that an individual has claimed to be your agent and is attempting to access or delete your information. We will also independently verify your identity to ensure that an unauthorized person is not attempting to impersonate you and exercise your rights without authorization. We will not share your information or honor any other requests in those situations where you cannot or do not grant permission in writing for an identified authorized agent to act on your behalf, or where we cannot independently verify your identity.

B.    Notice to Colorado Residents

To the extent any Colorado data privacy law applies to the collection of your Information, this supplemental section of our Privacy Policy outlines the individual rights guaranteed to Colorado residents and how to exercise those rights and applies solely to Colorado residents.  We provide the supplemental section below to comply with the Colorado Privacy Act (“CPA”) and any terms defined in the CPA have the same meaning when used below.   

Your Rights under CPA. Subject to certain exceptions you may be entitled to the following rights:

  • Right to Access & Data Portability.  You have the right to request that we disclose certain information to you about our collection and use of your Information at any time.  Once we receive and confirm an authenticated consumer request from you, we will, subject to certain exceptions:
    • Disclose whether we are processing your Information.
    • Provide you with access to your Information where we process it.

Where exercising your right to access, you have the right to request and obtain a copy of your Information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the Information to another data controller without hindrance (“data portability”).

  • Right to Correct Inaccurate Information.  To the extent that we may maintain inaccurate personal Information, you have the right to request that we correct such inaccurate personal Information taking into account the nature of the personal information and the purposes of the processing of the personal information.  Once we receive and verify your authenticated consumer request, we will use commercially reasonable efforts to correct your personal information.
  • Right to Delete.  You have the right to request that we delete certain of your information provided by or obtained about you.  To the extent that we can delete your information, once we receive and confirm your authenticated consumer request, we will delete your information, subject to certain exceptions.
  • Sale of Personal Information, Targeted Advertising, Profiling, and the Right to Opt Out.  You have the right to opt out of the processing of your information for the following purposes:
    • Targeted advertising.
    • Sale of your Information.
    • Profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

IV. Exercising Your Data Subject Rights

To exercise any of the rights described above, please submit a verifiable consumer request to us via the methods described below.  The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Information, or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

To help protect your privacy and maintain security, if you request access to or deletion of your Information, we will take steps and may require you to provide certain information to verify your identity before granting you access to your Information or complying with your request.  In addition, if you ask us to provide you with specific pieces of Information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose Information is the subject of the request.  Only you or your authorized agent may make a verifiable consumer request related to your Information.  If you designate an authorized agent to make a request on your behalf, we may require you to provide the authorized agent written permission to do so and to verify your own identity directly with us (as described above).
