This past September, the Departments of Labor (DOL), Treasury, and Health and Human Services released the final rule for the Mental Health Parity and Addiction Equity Act (MHPAEA). As these agencies increase compliance audits, self-insured plan sponsors, along with their third-party service providers, face challenges in developing their plans’ NQTL analyses.
The new regulations require self-funded plans to collect specific data and conduct a thorough evaluation to assess the impact of NQTLs on mental health benefits compared to medical benefits under the plan.

HIPAA Privacy Changes: What It Means for Reproductive Health

Deemed necessary by the Department of Health and Human Services (HHS) following the U.S. Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization and its aftermath of state-level abortion laws, HHS issued a HIPAA Privacy Rule to Support Reproductive Health Care Privacy (the “2024 Privacy Rule”). The 2024 Privacy Rule amends the HIPAA privacy rule to afford greater protection to protected health information (PHI) that is related to reproductive health care, with the goal of maintaining the necessary trust between patient and healthcare provider. Compliance with the 2024 Privacy Rule is required by December 22, 2024.
